1. SCOPE OF SERVICES
• Poriseba coordinates trained, verified professionals for home nursing, GDA / caregiver attendants, physiotherapy, dialysis support, home ICU, doctor home visits and PCA training.
• We act as a coordinating and facilitating agency — care is delivered at the client's residence or a specified location.
• Exact services availed are as agreed in the individual service agreement or booking confirmation.

2. PATIENT ASSESSMENT & ELIGIBILITY
• A preliminary assessment of the patient's condition, care needs, and home environment may be conducted before or at the start of service.
• Poriseba may decline, modify, or discontinue a service where care needs exceed what home healthcare can safely provide, or where staff safety is at risk.
• The client must provide complete, accurate medical history, medication, allergy and behavioural information at onboarding and throughout the engagement.

3. BOOKING & CONFIRMATION
• A service is confirmed only on written or verbal acknowledgment from Poriseba, with agreed duration, shift timings and charges.
• Staff are assigned based on availability; a specific caregiver or nurse is not guaranteed unless explicitly confirmed.

4. FEES & PAYMENT TERMS
• Charges are communicated before service begins, based on service type, duration, shift pattern and specialised care needs.
• Payment terms — advance, periodic, or post-service billing — are set at booking; continued service depends on timely payment.
• Consumables, equipment rental, transport, or emergency costs outside the agreed scope are billed separately.
• Poriseba may revise charges with prior notice, particularly for long-duration or renewed engagements.

5. CANCELLATION, RESCHEDULING & REFUNDS
• Advance notice is required to cancel or reschedule a booked service, allowing Poriseba to reallocate staff.
• Late cancellations — after a caregiver has been dispatched or reported for duty — may attract a cancellation charge.
• Refunds apply to services not rendered, net of costs already incurred; partial shifts and client-terminated engagements are not guaranteed a refund.

6. CAREGIVER & STAFF CONDUCT
• All engaged staff are expected to maintain professionalism, punctuality, hygiene, and respectful conduct.
• Conduct or performance concerns should be reported to Poriseba promptly so a replacement or correction can be arranged.
• Poriseba will make reasonable efforts to provide a replacement caregiver, subject to availability.

7. CLIENT / HOUSEHOLD RESPONSIBILITIES
• The client provides a safe, hygienic, and reasonably equipped environment for the caregiver or nurse.
• Assigned staff cannot be required to perform tasks outside the agreed scope of care without prior mutual agreement.
• The client is responsible for safeguarding valuables and arranging appropriate supervision where required.

8. EMERGENCY & MEDICAL SITUATIONS
• In a medical emergency, staff take reasonable immediate steps and promptly inform the client / family and the treating physician or nearest hospital.
• Poriseba is not a substitute for hospital-based emergency or critical care — final decisions on hospitalisation and treatment rest with the client, family, and treating doctors.

9. CONFIDENTIALITY & PRIVACY
• Poriseba and its engaged staff treat all patient medical information and household details as confidential.
• Information is not disclosed to third parties, except where required for coordinating care, billing, or as mandated by law.

10. LIMITATION OF LIABILITY
• Poriseba exercises reasonable care in staff selection and coordination, but is not liable for medical outcomes, complications, or pre-existing conditions — except where proven negligence or misconduct of engaged staff is established.
• Where liability is established, it is limited to the value of the specific service engagement and excludes indirect or consequential loss.

11. INDEMNITY & TERMINATION
• The client indemnifies Poriseba against claims arising from inaccurate patient information, equipment misuse, or non-disclosure of medical history.
• Either party may terminate a service engagement with reasonable prior notice.
• Poriseba may discontinue service immediately in cases of abusive behaviour toward staff, non-payment, or risk to staff safety.

12. FORCE MAJEURE & GOVERNING LAW
• Poriseba is not responsible for delays or service failures caused by circumstances beyond its reasonable control — natural disasters, strikes, civil unrest, pandemics, or government restrictions.
• These Terms are governed by the laws of India; disputes fall under the jurisdiction of the courts in Kolkata, West Bengal.
• Parties are encouraged to resolve disagreements through mutual discussion before pursuing formal legal recourse.

13. AMENDMENTS & CONTACT
• Poriseba may update these Terms & Conditions from time to time; updated Terms apply to services availed thereafter.
